Parties to AAA Consumer Arbitration may choose to try a solution themselves by submitting settlement offers and counter-offers via an online portal. This online runtime tool is part of AAA WebFile®. Parties, individuals and representatives of parties with access to the records can use the tool at any time. (Please note that this tool is only available for cases of consumption with two parts.) The AAA has developed the ClauseBuilder online tool® – a simple and self-directed process – to help individuals and organizations develop clear and effective arbitration and mediation agreements. Alternative Dispute Resolution (ADR) allows parties to adapt their dispute resolution process. Parties can include the standard arbitration or mediation clause in their contract and further adjust their clause with options that control time and cost. Non-binding arbitration provides the procedures of standard arbitration – but with an informal hearing on the merits and without the finality of a binding decision. Non-binding arbitration can be useful in less complex business-to-business and business-to-consumer disputes, where the parties may be too far apart in their views to mediate or need an assessment of their respective positions. Parties can search for companies by name to determine whether the AAA has reviewed its consumer arbitration clause and whether the AAA will handle its case, as well as to see the arbitration clause approved. These cases range from contract or license violations, commercial crimes and franchises to construction and infrastructure litigation in companies ranging from start-ups to the Fortune 500 in a variety of industries. The online settlement tool is available as the arbitration progresses, or the arbitration may be suspended by partisan agreement while the parties attempt an online settlement. Neither the AAA nor the arbitrator will review online communications between the parties.
